SUV Crashes Into Kissimmee Home, Catches Fire
Having a medical episode can be a scary situation. It can be especially frightening when the person is behind the wheel at the time.
This was recently the case in Kissimmee. A driver suffered a medical emergency and crashed into a home. The driver was injured in the accident. The incident happened on the evening of May 4 on Camino Real Drive.
A 38-year-old Kissimmee man was driving an SUV when he suffered a medical issue and lost control. The speeding vehicle was traveling down a sidewalk before hitting a mailbox and narrowly missing a vehicle before crashing into a home.
The SUV hit the front of the house and went into the living room. The vehicle then caught fire.
The homeowner was lying on his bed when he heard what sounded like an explosion. He jumped up and watched his closet fall down. The top had collapsed.
He went downstairs and heard his family screaming. He then saw the SUV in his living room, surrounded by smoke. There were eight people inside the home, but fortunately, none were injured. The family was able to rescue their dogs, but sadly, a pet bird was killed in the crash. The driver of the SUV was taken to the hospital.
The family is glad that everyone is safe. The kids normally play by the window where the SUV crashed, so if the crash happened at a different time, it could have been a tragic situation.
A neighbor saw the crash and called 911. They agreed that “it was a miracle that nobody else got hurt,” as the area is usually busy with joggers and children.
Medical Emergencies While Driving
A medical emergency can happen at any time. A sudden event like a stroke, heart attack, or choking that affects the driver can result in a car accident. So what happened in these cases? If the driver crashes and causes damages, are they still liable even though the situation was out of their control?
In most states, including Florida, the Sudden Medical Emergency Defense can release a driver from liability for an accident if it was caused by an unforeseen medical emergency and the loss of consciousness was sudden.
Foreseeability is a concept used to determine whether or not the driver could have reasonably anticipated that their action or failure to act would cause another person to be injured. They would have to prove all the following:
- They suddenly lost consciousness.
- The loss of consciousness was caused by an unforeseeable medical event.
- The loss of consciousness caused them to lose control of the vehicle.
