Our Areas of Practice
  • Trucking Accidents

In its annual traffic crash report, the Florida Department of Highway Safety and Motor Vehicles defines a commercial motor vehicle (CMV) as a bus, truck, vehicle transporting hazardous materials, or a vehicle weighing over 10,000 pounds. According to the latest data, 654 CMV crashes occurred in Osceola County in 2018, resulting in 315 injuries and ten fatalities. That’s nearly two crashes a day in this county alone, resulting in injury or death nearly half the time. Truck accidents are traumatic and have the potential to cause the most severe injuries, and they are often caused by negligent truck drivers or trucking companies.

  • Motor Vehicle Accidents

Motor vehicle accidents can be minor or serious, but no matter what they just take a moment. Even though they last a few seconds, the repercussions of one of these accidents can last a lifetime. Cases involving injuries or death due to automobiles are the most common types of personal injury cases handled by Draper Law Office. Over the years, our motor vehicle & auto accident attorneys have become experts in a variety of cases, including car accidents, truck accidents, tractor trailer accidents, motorcycle accidents, bicycle accidents, and pedestrian accidents.

  • Motorcycle Accidents

When it comes to motorcycles, Florida leads the nation in a couple of ways – the highest (or nearly highest) number of motorcycle registrations and the most (or nearly most) motorcycle crashes, injuries and deaths. In any collision, especially a high-speed impact, the virtually unprotected motorcycle rider almost always risks severe injury or worse. Statistics show that motorcycle riders account for approximately 20% of traffic deaths in Florida every year, even though less than ten percent of motor vehicles registered in the state are motorcycles. No matter how skilled or attentive riders are, they are no match for a negligent, reckless or aggressive driver, especially one who is drinking and driving or texting while driving.

  • Bicycle Accidents

Year after year, Florida leads the nation as the state with the highest or second-highest number of bicyclist fatalities. Tragically, the state sees over 6,000 injuries and more than a hundred deaths annually. Osceola County, over a recent three-year period, averaged 94 crashes resulting in 90 injuries and three deaths. Cycling is a great form of exercise, an enjoyable recreational activity, and an efficient and environmentally friendly way to get around town. However, bicycles have to share the road with cars and trucks weighing thousands of pounds and traveling at double or triple the speed of a bicycle. Bicycles are less visible than other vehicles on the road, and cyclists are largely unprotected in the event of a crash. For these reasons, bicycle riders are far more likely to be severely injured or killed in a collision than victims of accidents involving only motor vehicles.

  • Pedestrian Accidents

According to statistics from the Florida Department of Highway Safety and Motor Vehicles, on average, around 8,000 pedestrians suffer injury every year, and around 700 pedestrians lose their lives in a pedestrian accident. Pedestrian injuries and deaths top 100 annually in Osceola County. Between speeding and drunk driving and the rising rate of distracted driving here and around the country, pedestrians in Kissimmee, Celebration, Davenport and St. Cloud face many dangers when all they are trying to do is walk down the sidewalk or cross the street safely.

  • Insurance Disputes

Insurance is a way of managing risk in your life. To protect yourself against a costly expense, you buy insurance and pay a little each month to keep the policy active. If that expensive need does arise, your insurance policy will kick in with benefits to cover that cost. Some insurance is required by law, such as Personal Injury Protection or Property Damage Liability insurance on your vehicle, or health insurance required under the Affordable Care Act. Other times, the bank loaning you money to buy a house or the car dealership leasing you a vehicle will require you to maintain a certain amount of homeowners insurance or car insurance as a condition of the loan.

  • Work Related Accidents

  • Dog Bites

Numerous sources cite Florida as a leading state with either the most or nearly the most dog bites in the country year after year. According to the Florida Department of Health, dog bites are responsible for 600 hospitalizations and two deaths annually. Dog bites are painful, frightening attacks that can leave permanent physical and emotional scars. Dog bite victims can suffer muscle and nerve damage, facial lacerations, and deep wounds and bacterial infections that put them at risk for rabies or sepsis and organ failure or death. Dog bites affect people in every age group, but children are among the hardest hit. They are among the most often attacked and often suffer the worst injuries or death.

  • Slip and Fall

Slip and fall accidents are common, often embarrassing, incidents that happen every day. They can also cause severe injuries, including broken bones, back and neck injuries, head injuries, facial lacerations, strains, sprains and muscle tears. Slip and fall accidents send one million people to the emergency room every year. Falls are the leading cause of traumatic brain injuries and are responsible for deaths in the tens of thousands annually. For those over 65, falls are the leading cause of accidental injury and death.

  • Wrongful Death

The death of a loved one caused by another’s negligence or misconduct is more than just tragic and heart-breaking. It almost always puts a significant financial burden on the surviving family members, who are left dealing with medical and funeral expenses and the loss of a primary or secondary wage-earner, an essential caretaker for the children, or an invaluable manager of the household. Florida law recognizes the right of families to recover for these costs, as well as compensation for the pain and suffering endured.

  • Dissolution of Marriage

Dissolution of marriage is another term for divorce, and, as mentioned, it is the main focus of Draper Law Office’s family law practice. Divorce can often can be confusing and emotional, and it is important to find the right attorney to help guide you through the legal process.

  • Custody (Parental Responsibility/Time Sharing)

While many people only think of custody cases as those involved during a divorce, parental custody issues can also arise in other situations as well. Whether you are not married, married, or going through a divorce, you should know and understand your legal rights in child custody matters.

  • Child Support

At Draper Law Office, we can help you through every aspect of the process of paying or receiving child support. Our child support lawyers can help with the initial determination of support, as well as any modifications of the original order of support. We also can provide you representation at any Department of Revenue or Child Support Enforcement hearings.

  • Paternity

By definition, paternity is a term applied to an individual with children who is not married to the other parent. Paternity is important to establish for a variety of reasons. It provides children with a sense of identity and also may help them understand their health history – based on the histories of the mother and father. More importantly, the state has an interest in ensuring children are financially and emotionally supported.

  • Visitation/Time Sharing

At the Draper Law Office, we work with all aspects of child custody cases, including timesharing. Our child visitation lawyers can provide representation to parents seeking to establish their right to have time with their children, help contact their children and also to modify any current time sharing agreements.

  • Injunctions/Domestic Violence

The domestic violence protection lawyers at Draper Law Office are dedicated to helping in a variety of family law cases, including working with injunctions and domestic violence cases. Injunctions are also known as restraining orders, or Orders of Protection. There are four types of civil injunctions that can be filed with the Clerk of Court: domestic violence, sexual violence, dating violence, and repeat violence. Each has different requirements based upon your relationship with the other person and what occurred.

  • Equitable Distribution

Equitable Distribution refers to the division between spouses of tangible and intangible property, real property, assets and debts, and usually occurs in conjunction with the Dissolution of Marriage action. Equitable is not necessarily synonymous with equal in all cases. In Florida, it is first determined if either spouse has “non marital” property owned separately and not subject to division in the divorce. This separate property can include items or property listed in a premarital agreement, and any income from this property that has been kept separate, inheritance and even debt.

  • Alimony

Alimony is referred to by many different names, including spousal support or maintenance. Alimony may be awarded to a spouse in a divorce when they believe that they have a need for financial assistance and the other party has an ability to pay. It can be awarded as temporary, until the final divorce hearing is held, or it can be “permanent”. “Permanent” alimony may be awarded after a long term marriage (17 years or more), a moderately long marriage with certain circumstances, or a short marriage with exceptional circumstances. It may be periodic or lump sum. If permanent alimony payments are not appropriate, durational payments might be awarded to provide economic assistance for a set period of time not to exceed the length of the marriage. The court also may award rehabilitative alimony, based upon a plan for education or training a spouse to re-enter the workforce.

Motor Vehicle Accidents in Kissimmee

Florida’s no-fault insurance laws prohibit lawsuits against negligent drivers unless the victim suffers a severe or permanent injury as defined in the law. In these unfortunate situations, we help injury victims and their families recover the full amount of compensation to cover their medical bills, lost wages and pain and suffering by proving the at-fault driver’s negligence and liability to the people they harmed. Our comprehensive motor vehicle accident practice includes car accidents, truck accidents and motorcycle accidents, bicycle accidents and pedestrian accidents. Our lawyers are skilled at holding drivers accountable for distracted driving car accidents and drunk driving crashes, and we further know the appropriate steps to help accident victims hit by an uninsured driver.

Personal Injury Claims in Osceola County

Recovering compensation in a personal injury case requires proving the defendant’s negligence, their breach of a duty they owed to the victim, the link between their negligence and the injury, and the significant amount of damage they caused. Meanwhile, defendants and their insurance companies fend off these claims by trying to blame the injury victim or arguing they aren’t really hurt. Our decades of experience in personal injury claims enables us to build a solid case against the negligent party while defending our clients against allegations of their own negligence. From slip and falls to dog bites, we fight to ensure our clients get the medical care and compensation they need and deserve. Our comprehensive Kissimmee personal injury practice includes advocating for our clients in property damage claims and insurance disputes, as well as helping families recover valuable financial assistance and support after the wrongful death of a loved one caused by another’s negligence or misconduct.

Divorce in Kissimmee & Osceola County

Divorce, or dissolution of marriage, is available in Florida on no-fault grounds, meaning one party doesn’t have to prove the other spouse is responsible for destroying the marriage. This doesn’t mean that divorces are not contested, however. Unless the parties can agree on how to resolve issues such as the equitable distribution of marital property, the payment of alimony, and the custody of the children (parenting and time-sharing), these matters have to be litigated in court and decided by the judge. We’ll work with you to resolve these issues in the most cost-efficient and effective manner, always zealously guarding your rights and looking out for your best interests and the needs of your children.

Family Law

While divorce occupies the bulk of our firm’s family law practice, we help individuals and families in a myriad of other ways, as well. We counsel and assist parties dealing with domestic violence injunctions, including sexual violence orders of protection, dating violence injunctions, and repeat violence injunctions. We handle child support matters to ensure fair financial arrangements for your children, as well as child visitation disputes to protect your parenting time. Finally, we provide practical advice and passionate advocacy in Florida paternity proceedings, essential for parents to enforce rights to custody and child support.

Kissimmee Personal Injury & Family Law FAQs

How long do I have to file a personal injury lawsuit in Florida?

Florida’s statute of limitations generally gives you two years from the date of your injury to file a personal injury lawsuit. Waiting too long can result in losing your right to seek compensation entirely. It is important to contact a Kissimmee personal injury lawyer as soon as possible after an accident so that evidence can be preserved and your claim can be properly evaluated within the legal deadline.

What should I do immediately after a car accident in Kissimmee?

After a car accident, you should call 911 and seek medical attention, even if you feel fine, since some injuries do not present symptoms right away. Document the scene by taking photos of vehicle damage, road conditions and any visible injuries. Exchange information with the other driver and get contact details from witnesses. Avoid making statements about fault to anyone at the scene or to the insurance company before speaking with an attorney.

How much does it cost to hire a personal injury lawyer at Draper Law Office?

Draper Law Office handles personal injury cases on a contingency fee basis, which means you pay no upfront costs and no attorney fees unless we recover compensation for you. This arrangement allows anyone who has been injured due to someone else’s negligence to access quality legal representation regardless of their financial situation.

What types of compensation can I recover in a personal injury claim?

Depending on the circumstances of your case, you may be able to recover compensation for medical expenses, lost wages, loss of earning capacity, pain and suffering, emotional distress and loss of enjoyment of life. In wrongful death cases, surviving family members may also recover funeral expenses and the loss of the deceased’s financial support and companionship.

Do I need a lawyer for a Florida divorce?

While Florida law does not require you to have a lawyer for a divorce, having experienced legal representation is strongly recommended, especially when issues like child custody, alimony, equitable distribution of assets or domestic violence are involved. A knowledgeable Kissimmee divorce lawyer can protect your rights, ensure a fair outcome and help you avoid costly mistakes that could affect you for years to come.

How is child custody determined in Florida?

Florida courts determine child custody, referred to as parenting and time-sharing, based on the best interests of the child. The court considers a wide range of factors, including each parent’s ability to meet the child’s needs, the stability of each home environment, the child’s relationship with each parent and any history of domestic violence or substance abuse. Florida law encourages shared parental responsibility unless it would be detrimental to the child.

What is equitable distribution in a Florida divorce?

Equitable distribution is the process Florida courts use to divide marital assets and liabilities during a divorce. Equitable does not necessarily mean equal. The court considers factors such as each spouse’s contributions to the marriage, the duration of the marriage, each spouse’s economic circumstances, and whether either spouse intentionally wasted or depleted marital assets. Separate or non-marital property is generally not subject to division.

Can I still recover damages if I was partially at fault for my accident?

Florida follows a modified comparative negligence system, meaning you can still recover compensation even if you were partially at fault for the accident, as long as your share of fault does not exceed 50 percent. However, your total recovery will be reduced by your percentage of fault. For example, if you are found 20 percent at fault and your damages total $100,000, your recovery would be reduced to $80,000.

How long does a divorce take in Florida?

The length of a divorce in Florida varies depending on whether the case is contested or uncontested. An uncontested divorce where both parties agree on all issues can be finalized in as little as a few weeks. Contested divorces involving disputes over child custody, alimony or property division can take several months to over a year. Your attorney at Draper Law Office will work to resolve your case as efficiently as possible while protecting your interests.

What is a domestic violence injunction in Florida?

A domestic violence injunction, commonly known as a restraining order, is a court order that provides protection to victims of domestic violence. In Florida, you can seek an injunction against a spouse, former spouse, co-parent, or anyone related by blood or marriage or who currently or previously resided with you as a family. The injunction can order the abuser to stay away from you, vacate a shared home and have no contact with you. Draper Law Office assists both petitioners seeking protection and respondents defending against injunction claims.
