Can Bicyclists Ride Their Bike On The Sidewalk?

Whether you are a motorist or a bicyclist, you need to know the rules for riding a bike in the Sunshine State. Bike riders are often treated as inferior to motorists, but the truth is that in Florida, the bicycle is legally defined as a vehicle, while the bicyclist is considered a driver, even though you do not need a license to ride a bike.

So does this mean that bicyclists need to ride in the road? Not necessarily. Bicycle riders are allowed to operate on the sidewalk at any time. They can also ride their bicycle on either side of the road. They do not have to be traveling in the same direction as traffic adjacent to them. The only restriction is that they cannot be in the physical travel lane if they choose to go in the opposite direction.

However, bicyclists still need to be respectful and follow the rules of the road. This means they must yield the right of way to any pedestrian walking on that sidewalk. They cannot run over people; they need to move out of the way for people who are walking.

Also, because bicycle riders are considered drivers, they must obey the same traffic laws as motorists. These laws include:

  • Stopping for stop signs and red lights.
  • Using lights at night.
  • Yielding the right of way when entering a roadway.
  • Always riding with a helmet (if under the age of 16).

Here are some other rules to keep in mind:

  • Clinging to motor vehicles while bicycling is not permitted.
  • Bicyclists may not leave a child in a child seat on a bicycle unattended.
  • Bicyclists may not wear headsets or earplugs while riding.

You should also know that since bicycles are considered motor vehicles, laws regarding alcohol use still apply. This means that bicyclists cannot legally ride while intoxicated. Possession of an open container of an alcoholic beverage is illegal for bike riders.

People riding electric bicycles are subject to these same rules. Also, keep in mind that while Florida law allows people to ride their bikes on the sidewalk, local municipalities can prohibit bikes from certain areas, so obey all signs and warnings. While children can ride their bikes on the sidewalks and roadways, parents and guardians are responsible for making sure their children follow all bike laws.

Law enforcement officers can and will issue citations when they observe a bike rider violating the law. However, officers are encouraged to use discretion and attempt to educate riders by explaining the law rather than citing them.
