If you live in Florida and are about to file for divorce, maybe you are wondering if you can make your spouse move out of the house. The answer is no. There will have to be a very good reason to evict your spouse from the house you are sharing with your spouse.

It does not matter whose name is on the title or mortgage. That is their residence.

It is not advisable to change the locks during a time when your spouse is out of the house, for example. If the police are called, they will say it is a civil matter, and that your spouse has to come in because it is their residence. It is seen as an abuse of the system to involve the police in such a way.
