When you file for divorce, you do not need to prove adultery. You just have to show that your marriage is irremediably broken. The court may consider adultery if one of the parties has a claim for alimony.

If the adulterer is seeking alimony, the court will not be very sympathetic to them. It could either affect that person’s claim to get alimony at all, or it could affect the amount that might be awarded.
